Clean Hands(깨끗한 손)의 원칙 영미법의 형평법상 '깨끗한 손(clean hands)'의 원칙. "형평법상의 구제를 구하는 자는 그와 관련하여서 부당한 행위를 하여서는 아니되며 그렇지 않은 경우 그러한 더러운 손을 한 자에게는 법원이 그 구제를 허용하지 않는다(a person seeking equitable relief must not have acted unfairly in relation to the transaction at issue. If the action appears to arise out of an illegal or immoral matter, the person bringing it is said to have "unclean hands," and the court will not grant relief to such a person. - Gilbert's Dictionary of Legal Terms)." 수용권 남용 등에 관하여 판단할 때에도 적용되어야 한다.

On ne peut être à la fois juge et partie. 판사이면서 동시에 소송 당사자가 될 수는 없다. 자신의 이해가 얽힌 문제를 자기가 결정지을 수 없다. Aliquis non debet esse judex in propria causa, quia non potest esse judex et pars Personne ne doit être juge de sa propre cause, parce qu'on ne peut être à la fois juge et partie. On ne peut pas rendre une décision juste lorsqu'on a un intérêt à la décision rendue.
